What is a Responsible Person?

A Responsible Person (RP) or Authorized Representative (AR) is a legally required entity that ensures your product complies with all relevant UK & EU regulations. The RP/AR is responsible for:

Acting as the official point of contact for regulators & enforcement authorities

Ensuring compliance with UK & EU safety and performance standards

Handling regulatory requests, post-market surveillance, and recall management

Who Needs a Responsible Person (RP) or Authorized Representative (AR)?

If your company is not legally established in the UK or EU, you must appoint a Responsible Person (RP) or Authorized Representative (AR) before selling regulated products in these markets.

Consumer Goods (GPSR 2023/988) – From December 2024, nearly all non-food consumer goods require an EU Responsible Person under the General Product Safety Regulation (GPSR). If you sell any consumer goods in the EU, you likely need an RP.

CE-Marked Products (Toys, Electronics, PPE, Medical Devices, etc.) – If your product requires a CE mark, you must appoint an Authorized Representative (AR) to comply with EU Directives.

Cosmetic Products – A Responsible Person (RP) is legally required under EU Regulation (EC) No 1223/2009 and UK Cosmetic Regulations.

Food, Supplements & Beverages – A Food Business Operator (FBO) is mandatory for UK & EU market access.

Chemicals & Hazardous Mixtures – An Only Representative (OR) is required for REACH compliance, SDS documentation, and PCN/UFI submissions.

UK & EU Responsible Person (RP) & Authorized Representative (AR) Requirements

Responsible Person (RP) for Cosmetics Required under EU Regulation (EC) No 1223/2009 & UK law. The RP ensures compliance, safety assessments, and market notifications. Without an RP, your cosmetic product cannot legally be sold in the UK or EU.
Food Business Operator (FBO) All food supplements & beverages require an FBO to oversee compliance, labeling, and safety reporting. Without an FBO, food products cannot legally be placed on the market.
Only Representative (OR) for Chemicals Non-EU/UK chemical brands must appoint an Only Representative (OR) to handle REACH registrations, SDS compliance, and PCN submissions. Failure to appoint an OR can result in blocked sales & regulatory fines.
Authorized Representative (AR) for CE-Marked Goods Non-EU/UK manufacturers must appoint an Authorized Representative (AR) for toys, electronics, PPE, and other CE-marked goods. Failure to appoint an AR can lead to market access restrictions and enforcement actions.
EU General Product Safety Regulation (GPSR) From December 2024, companies selling consumer goods in the EU must comply with GPSR, including appointing a Responsible Person. Non-compliance can lead to product bans and regulatory fines.
